债权人代位权

代位权是民法中一个重要的人格权，其目的在于保护受害人和债权人的合法权益，也是债权人直接利用债务人权利来抗辩自己债权、收回欠款的方法。债权人代位权在我国民法中有着明确的法律规定，明确了债权人有权向债务人就他的权利行使代位权，并受法律的保护。



首先，债权人可以行使代位权受益物权，以维护自己的债权主体利益。当债务人被约束而不能行使其自己之后，债权人可以代其行使要求其支付或其它性质的利益物权，也可以申请令债务人履行归还债务义务，以此来维护其债权。

第三，债权人可以行使代位权捍卫权。债权人可以代债务人做出必要的合法行为，以保护其债权不受侵害，比如当债务人有过期不偿付债务的情况下，债权人可以代位申请司法裁定、判决，以便收回该债务。

此外，债权人也可以行使代位权继承权。如果债务人去世，债权人可以代位继承债务人遗产，调解债权。有利于债权人收回未偿付的债务款项。

至此，可以看到，债权人有权行使债务人的代位权，以便收回本欠款。但是，债权人在行使代位权时应尊重原债务人的合法权益，不得以任何形式违反法律规定，否则将面临法律追究。
